Terms of service
1. General Provisions
1.1. SIA ESI GUDRINIEKS, registration No. 40203526155 (hereinafter – the Seller), owner of the website www.esigudrinieks.lv (hereinafter – the Website), operates a trading platform intended for the sale of digital and physical educational materials.
1.2. By purchasing products on the Website, a distance contract is concluded between the Buyer and the Seller. The contract is governed by the laws and regulations of the Republic of Latvia, including the Consumer Rights Protection Law and Cabinet Regulations regarding distance contracts.
1.3. All materials available on the Website (digital files, worksheets, educational materials, etc.) are protected by copyright.
1.4. It is prohibited to:
- resell digital materials purchased from the Website,
- distribute them to third parties,
- share them in closed groups or other channels.
If unauthorized distribution of materials is detected, please report it to: info@esigudrinieks.lv.
1.5. In accordance with Section 69.1 of the Copyright Law, a person is financially liable for any damages and moral harm caused by copyright infringement.
2. Placing Orders
2.1. Product prices and descriptions are indicated next to each product.
2.2. To place an order:
- select the product,
- add it to the cart,
- fill in the required information,
- choose a payment method,
- confirm the order and complete the payment.
2.3. An order is considered completed after successful receipt of payment.
3. Payment Terms
3.1. The currency used on the Website is Euro (EUR).
3.2. Purchases can be paid using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
- VISA and MasterCard payment cards
- PayPal
- Direct bank transfer
NB! When using internet banking payment, please confirm the order and click the button “Return to Merchant”.
3.3. Personal data necessary for payment processing is transferred to the licensed payment institution Maksekeskus AS.
3.4. The contract enters into force upon successful receipt of payment.
4. Delivery of Digital Products
4.1. After payment, digital materials are made available for download or sent to the Buyer’s indicated e-mail address.
4.2. The Buyer is responsible for providing a correct e-mail address.
4.3. Digital materials are intended for the Buyer’s personal use only.
5. Right of Withdrawal
5.1. In accordance with the Consumer Rights Protection Law, the Buyer has the right to withdraw from the purchase of a physical product within 14 calendar days from the date of receipt.
5.2. The right of withdrawal does not apply to digital products if:
- delivery has commenced with the Buyer’s consent,
- the Buyer has acknowledged that they understand the loss of the right of withdrawal after the download has started.
5.3. To exercise the right of withdrawal (for physical products), the Buyer must submit a withdrawal request by e-mail to: info@esigudrinieks.lv.
5.4. Refunds are processed within 14 days after the returned product has been received.
6. Non-Conforming Goods
6.1. The Seller is responsible for any non-conformity of goods that appears within 6 months after delivery.
6.2. The Buyer must notify the Seller of any non-conformity within 2 months of discovering it by writing to: info@esigudrinieks.lv.
6.3. The Buyer has the right to request:
- replacement of the product,
- repair or correction of defects,
- or a refund if the issue cannot be resolved.
7. Processing of Personal Data
7.1. The Seller processes only the personal data necessary for order fulfilment (name, surname, e-mail, payment information).
7.2. Personal data may be transferred to payment service providers to ensure transaction processing.
7.3. If the Buyer has agreed to receive marketing communications, the e-mail address may be used to send updates and offers.
The Buyer may unsubscribe from marketing communications at any time by writing to: info@esigudrinieks.lv.
8. Dispute Resolution
8.1. All disputes between the Buyer and the Seller shall be resolved through negotiations.
8.2. If no agreement is reached, disputes shall be settled in the courts of the Republic of Latvia in accordance with applicable laws.
8.3. The Buyer also has the right to contact the Consumer Rights Protection Centre or use the European Union Online Dispute Resolution platform.
